Terms of Use

1. These terms

These Terms of Use govern access to Dereva Prep through derevaprep.app and related Dereva Prep services. Dereva Prep is operated by CirclePoint Limited ("we"). By using Dereva Prep, creating an account, or buying Dereva Prep Premium, you agree to these terms. If you do not agree, do not use the service.

2. What Dereva Prep provides

Dereva Prep provides educational driving-theory practice, including quizzes, traffic-sign practice, Model Town Board exercises, progress tracking, and related learning tools for Kenya.

Dereva Prep is independent. It is not affiliated with, endorsed by, or an official service of the National Transport and Safety Authority (NTSA). Dereva Prep is not a substitute for a licensed driving school, an official curriculum, an official driving test, or professional driving instruction. Using Dereva Prep does not guarantee that you will pass an examination or be competent to drive.

3. Accounts and eligibility

You are responsible for information submitted through your account and for keeping your sign-in methods secure. Do not use another person's account without permission.

If you are under 18, do not create an account or submit personal data unless a parent or guardian has provided any consent required by law and your use is otherwise lawful. Dereva Prep may introduce age-verification or parental-consent steps where required.

4. Free access and Premium

Dereva Prep may offer limited guest or registered free access. Limits may be enforced by device/browser storage, account records, or backend usage records.

Premium plans are sold for the price and access period displayed before payment. The current product offers a one-time 30-day pass; passes bought under earlier plans keep their full access period. A purchase does not automatically renew unless Dereva Prep clearly introduces an auto-renewing plan in the future and you expressly agree to it.

Premium access begins after Dereva Prep receives or verifies successful payment. If a payment is pending, reversed, rejected, duplicated, or cannot be reconciled, access may remain pending while the transaction is reviewed.

5. Driving school apps

Some driving schools offer Dereva Prep under their own name and address, such as safestart.derevaprep.app. Access there is set by the school: during a pilot it may be free, and when the pilot ends you may need to pay to keep Premium on that school's app. Your progress is kept. Premium from a school's app works only on that app, not on derevaprep.app.

When a school charges, it sets the price and Dereva Prep collects it for the school through M-Pesa; the prompt shows the school's name as the account. You pay once, and access lasts until the school removes you. Payments on a school's app are non-refundable, except a double charge or a payment that didn't give you access, which we fix. Contact support@derevaprep.app about either.

6. M-Pesa payments, receipts, cancellations, and refunds

M-Pesa payments are processed through Safaricom's payment systems. Your M-Pesa provider's terms also apply to the payment itself. The M-Pesa prompt shows CirclePoint as the business you are paying. Dereva Prep never asks you to type your M-Pesa PIN into the Dereva Prep website.

Before paying, check the selected plan, access period, price, and phone number. If you are charged but Premium access is not provided, if you are charged more than once for the same intended purchase, or if a transaction record is wrong, contact support@derevaprep.app.

Any refund or cancellation will be handled in accordance with these terms, the circumstances of the transaction, and mandatory rights under Kenyan consumer law. Nothing in these terms removes a consumer right that cannot lawfully be excluded.

7. Acceptable use

You must not:

• attempt to bypass access limits, payment controls or authentication;
• interfere with the service, probe systems without authorisation, or misuse payment endpoints;
• copy, scrape, redistribute, resell, or commercially exploit Dereva Prep content except where you have permission or the law allows it;
• use Dereva Prep to impersonate another person, commit fraud, or interfere with another user's account; or
• use the service in a way that violates applicable law or another person's rights.

8. Content and intellectual property

Dereva Prep's original product design, software, explanations, questions, graphics, and learning content are protected by applicable intellectual property laws. Third-party material remains subject to the rights and licences of its respective owners. Limited personal use of the service does not transfer ownership of Dereva Prep content to you.

9. Service availability and changes

Dereva Prep may fix, change, add, remove, or suspend features where reasonably necessary for security, legal compliance, maintenance, product improvement, or business operation. We will not intentionally remove already-paid access without taking the user's remaining entitlement and applicable consumer rights into account.

10. Suspension and termination

Dereva Prep may restrict or suspend access for fraud, security abuse, unlawful activity, material breach of these terms, or conduct that threatens the service or other users. Where appropriate, we may investigate and allow a user to contact support before a final account decision.

11. Liability

To the maximum extent permitted by law, Dereva Prep is not liable for losses caused solely by reliance on practice content as a substitute for official rules, licensed instruction, or safe real-world driving judgment. Dereva Prep remains responsible for liabilities that cannot lawfully be excluded or limited.

12. Privacy

The Privacy Policy explains how Dereva Prep handles personal data and forms part of the information provided with these terms.

13. Governing law and disputes

These terms are governed by the laws of Kenya. The parties should first try to resolve ordinary support or payment disputes through Dereva Prep support. Nothing here prevents a user from using a regulator, court, tribunal, or consumer remedy available under applicable law.

14. Changes to these terms

Dereva Prep may update these terms when the service or legal requirements change. Material changes should be communicated appropriately. The effective date and version at the top of this page identify the published version.
